MPS is a company registered in the UK. It is a mutual not-for-profit organisation, owned by its members around the world. The rights and benefits of the members are governed by its Memorandum and Articles of Association.
As a member organisation, members participate and have rights in respect of its governance. There are different categories of membership (including voting, associate, corporate and deferred membership) which determine the extent to which a member can participate in governance. For example, voting members have the right to receive notice, attend and vote at MPS’s Annual General Meeting.
The benefits of membership available include advice, support and assistance with clinical negligence claims, Medical Council matters, support with complaints, disciplinary proceedings, inquests and criminal investigations arising from clinical practice, 24/7 medicolegal advice, risk prevention, CPD and more.
The scope of members’ right to request assistance for matters arising out of their professional practice depends upon the members’ needs. Whilst the majority of member benefits are available to all members, the right to request indemnity and defence services in the event of any clinical negligence claims is included for those who advise us of work that is not already indemnified by their employer or the state and this is reflected in the membership and subscription to which members pay to MPS.
The ability to request assistance with claims can also vary depending on the terms of the individual’s membership. Members with occurrence-based protection are able to access the benefits of membership and request assistance for any complaint or claim that arises from an adverse incident that occurs during the period of their MPS membership, regardless of when it was reported and the complaint or claim received. Members with claims-made protection can have the right to the same range of protection for incidents provided they both occur and are reported during membership, or occur during membership, and are either reported in the 30-day window at the end of membership or during extended reporting benefits (ERBs).
